NEW DELHI, OCTOBER 18— Having failed to secure the judicial inquiry report in the custodial killing of his father in April this year, Mohammed Rizwan of Baran district in Rajasthan has now sent a letter to the Chief Justice of Rajasthan High Court, seeking copies of the inquiry report, medical report and forensic science laboratory (FSL) report, apart from demanding adequate monetary compensation to his family.
Beseeching that his letter be treated as a Public Interest Litigation (PIL) application, Rizwan said that his 52-year-old father – Mohammed Ramzan – died in police custody on April 26, 2019 and a judicial probe was conducted to find out the causes of his death after registering an FIR against the police personnel on duty to provide protection to him, he has not been provided a copy of the report despite several efforts in the last over five months.
Rizwan, in his letter, stated that he had submitted an application in Kota district court seeking copy of the inquiry report on October 9, 2019. “But the court official concerned replied me in writing that inquiry report and other details are confidential and hence, its copies cannot be made available to anyone, except the court”, Rizwan, who runs a mobile shop in Kota, said in his letter.
He also pointed out deficiency in undertaking the probe. He said that while the magistrate conducting the inquiry recorded his statements, he did not allow him to place the statements of the deceased that was shared by him to mediapersons before his death and its video was made viral on social media. Rizwan said that his father had also told him about the police having beaten him with metal pipes while undergoing treatment in the SMS Hospital in Jaipur.
Rizwan in the letter said that through a registered post, he had also intimated the Kota district judge that he (Rizwan) was not permitted to give statements based on video of his father recorded by mediapersons.
Requesting that a fresh probe be conducted into the custodial killing of his father under the direct supervision of the High Court, Rizwan said that the HC must order all the courts in the state to ensure that the victims or their relatives were provided copies of the inquiry report so that they could use it to fight for justice.
“As a common citizen, even you will not agree to deny the copies of an inquiry report into the causes of death just by categorising them as confidential papers”, Rizwan said in his letter to the High Court.
Speaking to India Tomorrow over phone, Rizwan said that his father was sentenced to four years of imprisonment in 1991 in connection with an attempt to murder case filed by one of his friends against him in 1987. However, he was granted bail by the court subsequently. On February 2, 2018, his sentence was reduced to two years by the Kota district court which was also upheld by the high court. He was then put in jail in August 28, 2018.
He was on March 23, 2019, admitted to New Medical College Hospital, Kota, with kidney problems.
On April 21, 2019, he was referred to SMS Hospital in Jaipur where he was allegedly beaten by the cops on his security duty. When his family members went to meet him in the hospital, he alleged that he was beaten up by metal pipes by the policemen inside the hospital. He also gave similar statements to media.
He was subsequently referred to the Kota hospital as the SMS Hospital doctors said that the same treatment was available in the Kota hospital as well.
Ramzan expired on April 26, 2019, in Kota hospital itself. It created lot of controversy, with several social and human rights organisations severely condemning the police and demanding registration of FIR against the police personnel on duty for Ramzan.

An FIR was registered and an inquiry also conducted into the causes of his death but no further progress has been reported in the case till so far, forcing victim’s son taking up the matter with the Rajasthan High Court Chief Justice.

*मुख्य न्यायाधीश को लिखा पत्र*
प्रतिष्ठा में,
माननीय मुख्य न्यायाधीश महोदय,
राजस्थान उच्च न्यायालय जयपुर राज0
जरिये- माननीय रजिस्ट्रार महोदय, जयपुर बेंच राजस्थान
विषय- कोटा महावीर नगर थाना क्षेत्र मे प्रार्थी के पिता की हिरासत मे मौत की जांच रिपोर्ट एवं अन्य संबंधित दस्तावेजात प्रार्थी को अग्रिम कार्यवाही के लिये दिये जाने के निर्देश देने के क्रम में।
मान्यवर,
उपरोक्त विषय में निवेदन है कि प्रार्थी के पिता स्व0 श्री मोहम्मद रमजान मांगरोल बारां के एक मामले मे सजायाफ्ता कैदी थे जिनकी हिरासत मे पुलिस द्वारा बैरहमी से पिटाई करने के कारण पुलिस हिरासत मे मौत हो गई। जिसका मर्ग 9/19 पुलिस थाना महावीर नगर कोटा मे दर्ज हुआ जिसकी जांच विधिक प्रावधानों के तहत माननीय जिला जज कोटा के निर्देषानुसार न्यायालय 4 उत्तर का चार्ज ग्रहण कर रही माननीय न्यायिक मजिस्टेªट न्यायालय 3 दक्षिण कोटा द्वारा की गई जिसकी जांच पुर्ण हो चुकी है जांच के दौरान प्रार्थी के बयान तो रेकार्ड किये किन्तु प्रार्थी द्वारा मृतक के हिरासत मे आई चोटे और मृतक द्वारा पत्रकार को विडियो के रूप मे विडियों रिकोर्डेड बयान प्रस्तुत करने की अनुमति नही दी प्रार्थी ने इस संबंध मे माननीय जिला अध्यक्ष को लिखित मे रजिस्ट्री कर प्रार्थना भी की थी।
मान्यवर उक्त न्यायिक मजिस्ट्रेट जांच सपुर्ण हो चुकी है प्रार्थी ने प्रार्थी के स्वर्गीय पिता मोहम्मद रमजान की मृत्यु के मामले मे क्या कार्यवाही हुई, क्या निष्कर्ष जांच रिपोर्ट तैयार हुई, पोस्टमार्टम रिपोर्ट बयान, एफ एस एल रिपोर्ट, संपुर्ण जांच रिपोर्ट प्राप्त करने के लिये माननीय जिला न्यायाधीश कोटा के अधिनस्थ कोटा जिला न्यायालय के नकल विभाग मे अर्जेन्ट नकल प्राप्त करने के लिये 2 रूपये का टिकिट लगाकर दिनांक 9-10-19 को आवेदन किया जिसका नकल आवेदन क्रमांक 46263 है।
मान्यवर दिनांक 14-10-19 को प्रभारी अधिकारी नकल विभाग ने नकल प्रार्थना पत्र की पुष्त पर आवेदक द्वारा नकल प्रार्थन पत्र द्वारा जो वांछित दस्तावेज नकल आवेदक द्वारा चाही गई है उक्त दस्तावेज न्यायालय के गोपनीय दस्तावेज हैं। अतः गोपनीय दस्तावेजों की नकल जारी करना न्यायोचित प्रतीत नही होता है। अतः आवेदक का नकल प्रार्थना पत्र खारिज किया जाता है।
मान्यवर प्रार्थी मृतक मोहम्मद रमजान जिसकी हिरासत मे मौत हुई है और उसकी मृत्यु पूर्वशरीर पर चोटो के निशान है स्वयं मृतक ने मृत्यु पूर्व ईलाज के दौरान अपने वीडियो बयान मे उसके साथ हुई हिरासत मे हिंसा का विवरण दिया है ऐसे मे जब हमारे संविधान मे किसीभी मृतक के पुत्र को उसकी मृत्यु के कारणों को जांनने का अधिकार दिया गया हो, देश मे पारदर्शिता नियम के तहत सूचना के अधिकार का कानून लागू हो और न्यायिक जांच से संबंधित निष्कर्ष मृतक के परिजनों को जानने के अधिकार की परंपरा हो उस विधि नियमों के देश मे माननीय न्यायालय जिला कोटा के नियंत्रित अधिकारियों द्वारा प्रार्थी को उसके पिता की मृत्यु के कारणों की जांच रिपोर्ट गोपनीयता दस्तावेज होने के नाम पर देने से इंकार करना मेरी राय मे सामान्य नागरिक होने के नाते आप स्वयं भी विधि सम्मत नही ठहरायेगें।
मान्यवर मे एक गरीब व्यक्ति हूं मुझे विधिक ज्ञान नही है फिर भी मेरे पिता की मृत्यु हिरासत मे हो जाने के बाद मे खुद स्तब्ध हूं कि मेरे पिता की मृत्यु दिनांक 26-4-19 को पुलिस हिरासत मे होने के बाद आज दिनांक तक भी मुझे मेरे पिता की मृत्यु के कारणों की जानकारी बार-बार लिखित मे प्रयास करने विधि के अनुसार नकल का प्रार्थना पत्र देने के बावजूद भी सूचना के अधिकार अधिनियम की इस क्रान्ति मे मुझे अपने पिता की मृत्यु के कारणों की जानकारी उपलब्ध नही होने से मै व मेरा परिवार आहत हैै दुखी है मेरे व मेरे परिवार की मनस्थिति माननीय मुख्य न्यायाधीश महोदय स्वयं आंकलन कर सकते है।
मान्यवर मैं विधि नियमों को नही समझता बस एक बात समझता हूं कि आप राजस्थान के विधि नियमों एवं संविधान के संरक्षक हो आपसे गुजारिश है कि आप मेरे इस प्रार्थना पत्र को जनहित याचिका के रूप मे स्वीकार कर मुझे मेरे पिता की मोत के कारणों एवं की गई जांच संबंधित दस्तावेजों की नकल वगैराह दिलवायेै । मेरा आपसे यह भी निवेदन है कि उक्त हिरासत मे मोत से संबंधित समुचे प्रकरण की जांच आप अपने मार्गदर्शन मे मुझ द्वारा प्रस्तुत दस्तावेज चोट रिपोर्ट एवं प्रार्थी के पिता मृतक मोहम्मद रमजान के वीडियो बयान का आंकलन सत्यता की जांच करवाकर दोषी लोगों को दण्डित करवायें एवं उचित क्षतिपूर्ति मुआवजा भी दिलवाये। आपसे गुजारिश है कि सम्पूर्ण राजस्थान के न्यायालयों के अधिनस्थ नकल विभाग को यह भी निर्देशित करें कि किसी बेटे से उसके पिता या परिजन की मृत्यु कारणों की जांच के कारण जानने की जांच रिपोर्ट एवं दस्तावेजों की नकल प्राप्त कर निरीक्षण का हक नही छीने और उन्हे भविष्य में दिलवाते रहें।
अतः श्रीमान की सेवा मे प्रार्थना पत्र पेश कर निवेदन है कि प्रार्थी के उक्त दर्द को माननीय मुख्य न्यायाधीश महोदय सो मोटो जनहित याचिका मानकर जो भी उचित मार्ग निर्देशन न्यायिक सहायता क्षतिपूर्ति राशि संबंधित जो भी न्यायिक कार्यवाही वह दिलवाने के निर्देश प्रदान कर अनुग्रहित करें। में आपका आभारी हूं।
