NEW DELHI, JUNE 8—Senior advocate Mehmood Pracha has said that the chargesheets in the Northeast Delhi violence seem to have been prepared under pressure from the political bosses in the government.

In a video interview to India Tomorrow, Pracha alleged, “The chargesheets have no factual evidences against the accused. They appear to be one sided”. The police have so far submitted 78 charge-sheets in the court.

Well-known advocate, Pracha alleged, “The stories mentioned in the chargesheets are concocted with fake evidences managed by the police itself. There are no factual evidences. These seem to have been drafted under the direction of their political bosses”.

He suggested that people, who have been framed in fake cases, should take legal action against the police officials involved in preparation of chargesheets.

“All investigations have been done at the behest of big bosses sitting in the Home Ministry to suppress those who were involved in the protest against the Citizenship Amendment Act and the proposed National Register of Citizens. The cases are being registered under the Unlawful Activities (Prevention) Act (law for action against terror acts) to curb the protests against CAA/NRC. The police have not mentioned the names of the complainants in the FIRs. Going through the FIRs, it seems that people are being framed in fake cases. There is no evidence or allegation in the FIR that attracts UAPA against the accused persons. This is misuse of UAPA. Earlier, Terrorist and Disruptive Activities (Prevention) Act (TADA) and the Prevention of Terrorism Act (POTA) were misused by the police due to which the Parliament had revoked them. Now, again the Parliament has to think of reviewing the UAPA and revoke them as well”, Pracha said while commenting on the chargesheets.

When asked that BJP leader Kapil Mishra’s name is not mentioned in any FIR and the chargesheet, Pracha said that not only Kapil Mishra, other senior BJP leaders including ex-MLA Jagdish Pradhan’s names are not mentioned. “Several complaints against them are pending in police stations but no action has been taken so far. Only some lower rank activists of RSS and BJP have been arrested”, Pracha stated.

Speaking against one-sidedness in the FIR, Pracha said that all police actions being taken violating the government guidelines of lockdown imposed due to corona virus pandemic, suggest that “police are working under pressure of its political bosses”.

The police booked Jamia Millia Islamia students under the UAPA to threaten them so that in the future they do not participate in any kinds of protest against the government, he said.
